Ship Management Solutions Indonesia: How Ship Owners Appoint a Ship Agent for Port Calls
Foreign vessels calling Indonesian ports must work through a local ship agent, so appointing the right one is the first ship management decision for any owner trading here. This guide shows how an owner appoints a ship agent for port calls in Indonesia: who can be appointed, what to decide, what to send, and what to check along the way.
Why Owners Must Appoint a Ship Agent in Indonesia
Ship agency is regulated by the Minister of Transportation Regulation No. PM 11 of 2016. Under it, foreign shipping companies whose ships call at ports open to foreign trade must appoint a national ship agency company or a national shipping company as general agent. In practice, a foreign owner does not deal with customs, immigration, quarantine, and the harbour master directly. The agent does it on the owner’s behalf.
A national shipping company can act as agent for its own ships under its licence. If it has no branch office at the port, it appoints a local sub-agent. Rules change, so confirm the current regulation with your legal adviser or agent. Who can be appointed? A national ship agency company with a ship agency licence, or a national shipping company. An agency company must be owned by Indonesian citizens.
| Type | Who | Role |
| General agent | National ship agency company or national shipping company | Appointed by the foreign shipping company to handle the ship’s affairs in Indonesia |
| Sub-agent | A national agency or shipping company at the port. If none exists there, a pelayaran-rakyat company | Acts for the general agent at a port where it has no branch office |
| Agent for national ships | National ship agency company or national shipping company | Handles Indonesian-flag ships of national shipping companies |
Step 1: Decide What the Agent Should Do
Port formalities are the agent’s core job. Beyond that, decide how much local coordination to hand over. Write down what each vessel needs before arrival, at port, and after the call, then match it to a scope.
| Scope | What the agent does | Suits |
| Port formalities | Clearance, immigration, quarantine, customs coordination, authority communication | Simple port calls |
| Port formalities plus husbandry | Adds crew changes, spare parts, provisions, Cash to Master, medical help, technician attendance, transport | Most port calls |
| Extended support | Adds items such as underwater cleaning and dry docking coordination | Vessels with maintenance work in port |
A wider scope means one point of contact in each port. A narrower scope means the owner arranges more things directly. Technical, crew, and commercial management are separate decisions and are not part of the agent’s role.
Step 2: Shortlist and Check Candidates
A good agent is more than a low fee. Check these points before you appoint:
- Licence. A valid ship agency licence, or a national shipping company acting under its own licence. Ask to see it.
- Local experience. Knowledge of local procedures, port requirements, and operating conditions.
- Port coverage. Support at every Indonesian port your vessels call, directly or through sub-agents.
- Communication. Clear, timely updates between agent, vessel, and owner.
- Operational support. Ability to coordinate services beyond basic formalities.
- References. Ask for owners or operators who have used the agent at your ports.
Step 3: Agree the Terms and Costs
Put the agreement in writing before the first call. Fees differ by port and service, so ask for written quotes for a typical port call.
| Cost item | Paid to | How it is set |
| Agent fee for port formalities | Ship agent | Quoted per port call |
| Husbandry services | Agent or its suppliers | Quoted per service |
| Port dues and charges | Port authorities, usually through the agent | Set by the port |
| Repairs, cleaning, dry docking | Specialist suppliers | Quoted per job |
Port charges are separate from the agent’s fee. The agent settles port bills on the owner’s behalf, so ask for an estimate of port charges before arrival and a final account, with supporting invoices, after the call.
Also agree on these points:
- A written scope, listing what the agent does and what is charged separately.
- Who acts as sub-agent at ports where the agent has no branch office.
- How and how often the agent reports to the owner during a call.
- Who settles claims and disputes arising from the agency agreement. Have your legal adviser review this.
A cheap provider can become expensive through delays, detentions, or poor service, so compare service quality, not only price.
Step 4: Send the Appointment and Vessel Information
The appointment letter is a required part of the notice the agent files for a foreign ship. For non-scheduled ships, the agent submits a Notification of Foreign Ship Agency (PKKA). Send the agent what it needs early:
- The appointment letter naming the agent.
- Ship name, flag, and size.
- Ports of call, with planned arrival and departure times.
- Cargo type and volume.
- The crew list.
- Husbandry needs, such as crew change, spare parts, provisions, Cash to Master, medical help, or technician attendance.
Liner operators are notified with a schedule of at least six months, also through the appointed agent.
Step 5: Follow the Port Call
Once appointed, the agent runs the port call. The owner’s job is to respond quickly and check the results.
- The agent files the required notice and reports the planned arrival to the authorities.
- Before arrival, the agent prepares documents and plans husbandry services with the owner and master.
- On arrival, the agent handles clearance with immigration, quarantine, customs, and the harbour master.
- During the call, the agent coordinates crew changes, spare parts, provisions, and other services on board and with suppliers.
- After departure, the agent reports the departure and settles port bills.
- The owner reviews the final account against the estimate and raises any difference with the agent.
What Stays With the Owner
An agent reduces the port-side workload. It does not remove the owner’s own responsibilities.
- ISM Code. Without a valid Document of Compliance or Safety Management Certificate, a ship can be detained or barred from international trade. An agent does not replace these.
- Cabotage. Under Law No. 17 of 2008 on Shipping, domestic sea transport between Indonesian ports is reserved for Indonesian-flagged vessels with Indonesian crews. Foreign-flagged vessels may not carry passengers or cargo between Indonesian ports. Limited exemptions exist for special operations, such as offshore work.
- Law changes. Indonesia has amended its shipping rules more than once, including a third amendment (Law No. 66 of 2024). Check current rules before you commit.
- Vessel decisions. Safety, crewing, and technical decisions stay with the owner, master, and any ship manager.
